Biome Terms of Use

General

By accessing, browsing, or using the Biome app or website (collectively, “Biome”), you agree to be bound by these Terms of Use (“Terms”). Please review them carefully before using Biome. We reserve the right to modify, update, or delete portions of these Terms at any time at our sole discretion. Changes will be posted on this page with an updated effective date. Continued use of Biome following any such changes constitutes your acceptance of the revised Terms. If you do not agree, please discontinue use of Biome.

Definitions

“Biome” refers to the mobile application, website, and associated services made available on platforms such as Android OS, Apple iOS, or accessible via the internet. Biome is a platform designed to connect outdoor enthusiasts—hikers, climbers, backpackers, and nature lovers—allowing users to share experiences, connect socially, and explore outdoor content.

Data Protection and Privacy

Any personal information you provide to Biome will be handled in accordance with our Privacy Policy, which forms part of these Terms. Please review it to understand how we collect, use, and protect your data.

Conditions of Use

You agree not to use Biome in a manner that is illegal, abusive, or disruptive. This includes—but is not limited to—posting harmful, offensive, harassing, discriminatory, or otherwise inappropriate content.

You also agree not to:

• Impersonate other users or use their accounts without authorization.
• Upload or transmit any material that violates intellectual property rights or includes viruses or malicious code.
• Use Biome to promote spam or commercial solicitation.
• Use Biome in a way that interferes with other users' enjoyment of the platform.
• Reverse-engineer, decompile, or create derivative works from Biome's software, design, or services.

If you access Biome through a mobile network, your provider's terms still apply. If you're not the bill payer for the device, you must have permission from the bill payer to use Biome.

By posting content on Biome—including images, comments, or media—you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content solely for the purpose of operating, improving, securing, moderating, and supporting the platform. You retain full ownership of your content.

Community Promotion Authorization

Newly created Moments are visible to the user's Circle by default. When creating a Moment, users may be offered the option to allow Biome to review the content for possible inclusion in Community features.

By selecting this option, you authorize Biome to review the content through automated and human moderation processes and, if approved, promote the content from Circle visibility to Community visibility within the Biome platform.

Community-visible content may be displayed in Community feeds, discovery features, recommendations, showcases, promotional placements, or similar in-app experiences. Biome is not obligated to promote any content and may decline to feature or distribute content for any reason consistent with its policies.

If you do not allow Community promotion, Biome will not intentionally promote that Moment beyond its original Circle audience, except as necessary to operate, secure, moderate, enforce our policies, or comply with legal obligations.

Commercial Use and Solicitation

You may not use Biome to advertise, solicit, or promote any commercial goods, services, events, or organizations without obtaining prior written consent from Biome. This includes but is not limited to:

• Posting promotional content or links to third-party commercial websites.
• Soliciting users for business purposes, sponsorships, fundraising, or recruitment.
• Sending unsolicited messages or advertisements through Biome’s communication features.

Any unauthorized commercial use or solicitation may result in the removal of your content, suspension of your account, and/or legal action. To inquire about permitted commercial use, please contact us in advance at biome.help@gmail.com.

Availability

Biome strives for continuous uptime and smooth service, but we cannot guarantee uninterrupted access due to maintenance, technical issues, or external factors. Biome is not responsible for any loss or disruption caused by these issues.

Age Requirements

To use Biome, you must be at least 13 years old. By creating an account, you represent and warrant that you are 13 years of age or older and have the legal capacity to enter into these Terms.

We do not knowingly collect, use, or maintain personal information from children under 13. If we learn that a user under the age of 13 has created an account, we will delete the account and any associated data in accordance with applicable laws.

If you are between the ages of 13 and 17, you may use Biome only with the consent and supervision of a parent or legal guardian, who is responsible for reviewing and agreeing to these Terms on your behalf.

Termination

We may suspend or terminate your access to Biome without notice if you violate these Terms or act in a way that harms the Biome community. Upon termination, your rights to access the app or any content will cease.

Limitation of Liability

To the fullest extent permitted by law, Biome and its creators will not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your use of or inability to use the platform. This includes damage to your devices or data loss.

Disclaimer of Warranties

Biome is provided “as is” and “as available.” We make no guarantees regarding the accuracy, reliability, or availability of the platform and disclaim all implied warranties to the extent allowed by law.

Proprietary Rights

All content and materials on Biome, including the logo, app design, code, and intellectual property, are the property of Biome or its licensors. You may not reproduce or distribute any content without explicit written permission.

Privacy

We are committed to protecting your privacy. The information you share with us is used to operate Biome and improve your user experience. Please review our full Privacy Policy for details.

Collection of Personal Information

When registering for Biome, we may collect personal information such as your name, email, location preferences, and other details needed for community interaction and app functionality. We do not sell your personal information. We share information only as described in our Privacy Policy or as required by law.

Security

We take steps to safeguard your data using reasonable security measures. However, we cannot guarantee absolute security, especially if your own device or internet connection is compromised. You share your information at your own risk.

Biome may contain links to third-party websites or outdoor services. We are not responsible for the content, security, or privacy practices of these external sites.

Failure to Comply

Violation of these Terms may result in suspension or permanent removal from the Biome platform. Severe violations may incur legal action.
